Whirl.Video Privacy Policy

This Privacy Policy explains how Schumann & Tonks, doing business as Whirl.Video, collects, uses, discloses, and retains information when you use Whirl.Video.

1. Who Operates Whirl

Whirl.Video is operated by Schumann & Tonks, a Virginia general partnership. Its partners are William Raymond Neal Tonks and Jack Everett Schumann.

Whirl is an experimental, AI-assisted service for creating and editing motion-design videos.

2. Scope

This policy applies to Whirl’s website, account system, trial editor, video-generation features, and related communications.

Whirl is intended for adults located in the United States. It is not offered to residents of the European Union or United Kingdom during the alpha period.

3. Information We Collect

Information from Google authentication

When you create or access an account through Google, we receive and store basic authentication information made available by Google, such as your Google account identifier, email address, name, and related login information, depending on the permissions presented during sign-in.

We do not receive or store your Google password.

User Content

When you use account-based features, we collect the materials you provide, including:

  • images;
  • audio files;
  • logos;
  • photographs;
  • prompts and instructions;
  • project names and project information;
  • editing decisions; and
  • generated videos and related output files.

User Content may contain personal information about you or another person. You are responsible for obtaining permission before providing another person’s personal information, image, voice, or likeness.

Usage and device information

We and our providers may automatically collect:

  • IP address;
  • browser and device type;
  • operating system;
  • referral source;
  • pages and features visited;
  • dates and times of access;
  • buttons, links, and tools used;
  • generation and editing activity;
  • error, diagnostic, and performance information; and
  • cookie and advertising identifiers.

Session recordings

Whirl uses PostHog to record user sessions and activity within the service.

Session recordings may capture navigation, mouse movement, clicks, interface interactions, text entered into parts of the service, prompts, project information, and content displayed on screen.

Do not enter sensitive or confidential information into Whirl. Whirl’s use of session recording is one reason the service should not be treated as a confidential or secure repository.

Payment and subscription information

Paid subscriptions are handled through Stripe Managed Payments.

Stripe acts as merchant of record for eligible purchases and may collect:

  • name and contact information;
  • billing address;
  • payment-card or other payment details;
  • transaction information;
  • subscription status;
  • tax information;
  • refund and chargeback information; and
  • payment-related support communications.

Whirl does not directly store your complete payment-card number. We may receive limited information from Stripe, such as your subscription plan, subscription status, transaction identifiers, renewal status, and limited customer information needed to provide access.

Stripe processes information under the Stripe Privacy Policy.

Communications

If you contact us, we collect your email address and the contents of your communication, including information needed to respond to support, account-deletion, privacy, copyright, or legal requests.

4. How We Use Information

We use information to:

  • create and authenticate accounts;
  • provide the trial editor and account-based service;
  • receive, store, and process User Content;
  • generate and edit videos;
  • operate subscription features;
  • provide customer support;
  • troubleshoot errors;
  • review product performance;
  • understand how people use Whirl;
  • improve features and workflows;
  • prevent fraud, abuse, and security incidents;
  • enforce our Terms of Service;
  • comply with legal obligations;
  • investigate complaints;
  • measure advertising effectiveness; and
  • communicate about Whirl and material service changes.

5. AI and Inference Providers

Whirl uses multiple third-party AI model, media-processing, and inference providers. The providers used for a request may change based on cost, availability, and performance.

We may provide these services with:

  • uploaded images and audio;
  • prompts and instructions;
  • project information;
  • intermediate generation data; and
  • generated outputs.

Depending on a provider’s terms and configuration, the provider may retain this information or use it to train, evaluate, or improve its models or services.

You should assume that content uploaded to Whirl may be accessible to third-party AI providers and may be used for model training or service improvement.

Do not upload confidential, proprietary, privileged, regulated, or sensitive information.

You may contact us to request information about the categories of AI and inference providers currently in use.

6. Cookies, Analytics, and Advertising

Whirl uses cookies, local storage, pixels, and similar technologies.

Essential technologies

We use essential technologies to authenticate accounts, maintain sessions, provide security, and operate requested features.

PostHog

We use PostHog for analytics, product activity records, and session replay. PostHog helps us understand how users navigate Whirl, where errors occur, and which features are used.

Reddit advertising technology

We use Reddit advertising pixels or similar tools to:

  • determine whether a visit resulted from a Reddit advertisement;
  • measure advertising performance;
  • understand conversions; and
  • create, measure, or refine advertising audiences.

This activity may involve sharing cookie identifiers, IP addresses, device information, referral information, and activity on Whirl with Reddit.

Although we do not sell personal information for money, some state privacy laws may define certain advertising-related disclosures as a “sale,” “sharing,” or use for targeted advertising.

Your choices

You can limit cookies through your browser settings. Blocking cookies may prevent parts of Whirl from functioning correctly.

Where applicable law gives you a right to opt out of targeted advertising or qualifying advertising-related disclosures, you may submit a request using the contact information below.

7. How We Disclose Information

We may disclose information to the following categories of recipients:

Authentication providers

Google provides account authentication and processes information under its own privacy practices.

Payment provider and merchant of record

Stripe processes purchases, subscriptions, payment information, taxes, refunds, chargebacks, and related transaction support.

Hosting and content-delivery providers

We use Amazon S3 to store files and Amazon CloudFront to deliver files and service content.

Analytics providers

We use PostHog for analytics, activity records, and session replay.

Advertising providers

We use Reddit advertising technology to measure and improve advertising campaigns.

AI and inference providers

We provide User Content and related information to providers that perform AI generation, inference, media processing, and other technical operations.

Contractors

Authorized contractors may receive information when reasonably necessary to provide support, development, security, or debugging services.

Legal and safety disclosures

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with law, regulation, legal process, or a governmental request;
  • protect the rights, property, or safety of Whirl, its users, or another person;
  • investigate fraud, infringement, abuse, or security incidents;
  • enforce our Terms of Service; or
  • establish, exercise, or defend legal claims.

Business transactions

Information may be transferred as part of a financing, incorporation, reorganization, merger, asset transfer, sale, dissolution, or similar transaction involving Whirl or Schumann & Tonks.

8. Access by Whirl’s Partners

Whirl’s partners and authorized contractors may inspect User Content, prompts, projects, session recordings, and generated videos for:

  • support;
  • debugging;
  • quality review;
  • abuse prevention;
  • security;
  • enforcement of our Terms; and
  • product improvement.

Whirl-generated projects are private by default and are not made publicly available through Whirl. This does not prevent authorized access for the purposes described above.

We will not use a customer’s name, logo, assets, or generated video in public marketing without that customer’s separate, explicit permission.

9. Sensitive Information

Whirl is not designed to store sensitive or confidential information.

Do not provide:

  • Social Security, passport, driver’s-license, or government-identification numbers;
  • financial-account or payment-card details outside Stripe’s payment interface;
  • passwords or authentication credentials;
  • medical or health information;
  • biometric identifiers;
  • private financial records;
  • confidential customer or employee records;
  • trade secrets;
  • legally privileged information; or
  • information subject to contractual or professional confidentiality duties.

If you provide such information despite this warning, Whirl may process it through session recordings, hosting systems, contractors, or AI providers as described in this policy.

10. Data Retention

We retain account information, User Content, generated videos, analytics information, and communications for as long as reasonably necessary to:

  • provide the service;
  • maintain an active account;
  • improve and secure Whirl;
  • investigate disputes or abuse;
  • comply with legal obligations; and
  • maintain appropriate business records.

Because Whirl is an alpha product, projects may be deleted, reset, or become unavailable at any time. We do not promise permanent storage.

When you submit a verified deletion request, we will delete or de-identify information from our active systems within a reasonable period, except where retention is reasonably necessary for legal compliance, security, fraud prevention, accounting, dispute resolution, or enforcement of our agreements.

Residual copies may remain temporarily in backups and provider systems. Information transmitted to an AI or other third-party provider may be retained by that provider under its own terms and may not be retrievable or deletable by Whirl.

Stripe may retain transaction and payment information independently to meet its legal, tax, fraud-prevention, and financial-record obligations.

11. Account Deletion and Privacy Requests

You cannot currently delete your account directly within Whirl.

To request deletion, access, correction, a copy of information associated with your account, or an applicable advertising opt-out, email:

Include the email address connected to your Google-authenticated Whirl account and clearly describe your request.

We may ask for information reasonably necessary to verify your identity. We will not require you to create a new account solely to submit a privacy request.

Where applicable law provides a right to appeal our decision, you may appeal by replying to our response with the word “Appeal” and explaining why you believe the decision should be reconsidered.

12. Security

We use administrative, technical, and organizational measures intended to protect information.

No online service, alpha product, storage system, or transmission method is completely secure. We cannot guarantee that information will never be lost, accessed, disclosed, altered, or destroyed.

You should not use Whirl for information that requires guaranteed confidentiality, availability, integrity, or regulated security controls.

13. United States Processing

Whirl’s own persistent application storage is configured in the United States.

Information may nevertheless be transmitted to or processed by third-party providers according to their infrastructure, personnel, subprocessors, and applicable terms.

By using Whirl, you understand that your information will be processed in the United States and potentially by providers operating in other jurisdictions.

14. Children

Whirl is restricted to users who are at least 18 years old.

We do not knowingly offer Whirl to children or knowingly collect personal information from anyone under 18. If you believe a minor has provided information to Whirl, contact us so that we can investigate and delete it where appropriate.

15. Third-Party Links and Services

Whirl may link to or rely on third-party services. Their privacy practices are governed by their own policies, not this Privacy Policy.

We encourage you to review the policies of Google, Stripe, PostHog, Reddit, Amazon Web Services, and any other provider you interact with through Whirl.

16. Changes to This Policy

We may update this Privacy Policy as Whirl and its providers change.

We will post the updated policy and revise its effective date. When required by law, we will provide additional notice of material changes through the service, by email, or through another reasonable method.
